Unless expressly agreed otherwise, AdventureKingz GmbH is the contractual partner.
2. Scope
These terms apply to OrbitOne Web, Free and Pro plans, add-ons, clients, apps, extensions, APIs and related support. The Terms of Use also apply. OrbitOne is primarily directed at businesses and professional teams. Mandatory consumer rights remain unaffected where a consumer contract is formed.
3. Registration and contract
Submitting a registration is an offer to enter into a free user agreement; the agreement begins when the account is activated. Paid services require a separate checkout displaying price, billing period and taxes before the binding order. Registration details must be correct and current.
4. Services and availability
The scope follows the plan shown at checkout. Free and Pro differ mainly in limits, extensions and professional services. Beta, pilot and test functions may be limited, changed or discontinued. Continuous or error-free availability is not guaranteed; maintenance and security work may cause temporary restrictions.
5. Fees and payment
Business prices are net plus statutory VAT. Stripe may process payments. Recurring charges are due at the start of each billing period. After appropriate notice, paid functions may be limited following failed payment.
6. Customer duties
Customers protect credentials, passkeys, recovery keys and API tokens, configure roles carefully and report security incidents promptly. They are responsible for the legality of their content, invitations and processing activities.
7. Customer content
Rights in customer content remain with the customer or relevant rights holder. Customers grant only the technical rights required to store, transmit, convert and display content to authorised users. Customers should export or separately back up business-critical data unless a backup service is expressly agreed.
8. Privacy
See the Platform Privacy Notice. Where OrbitOne processes personal data on a business customer's instructions, a data processing agreement can be concluded.
9. Term, cancellation and export
Free runs indefinitely and can be ended at any time. Paid subscriptions run and renew according to the terms shown at checkout and can be cancelled through account management or in text form. Customers should export required data before deletion deadlines expire.
10. Liability
Liability is unlimited for intent, gross negligence, injury to life, body or health, product liability and expressly assumed guarantees. For slight negligence affecting essential contractual duties, liability is limited to typical foreseeable loss. Other liability for slight negligence is excluded where legally permitted.
11. Changes
Terms may be changed prospectively for objective reasons such as law, security or material product changes. Affected users will receive reasonable notice. Material adverse changes provide a termination option; renewed express acceptance is requested where legally required.
12. Governing law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Braunschweig is the venue for merchants and public-law entities. Mandatory venues remain unaffected. The German version is authoritative; this English version is a convenience translation.
